dc.description.abstract[por] Analisa o instituto da intervenção mínima na autonomia da vontade coletiva, introduzido no art. 8º, § 3º da CLT pela Lei n. 13.467/2017, como fator de exclusão social, haja vista que sua aplicação retira a proteção legal de trabalhadores por meio de negociação coletiva, sob o argumento de modernização das relações de trabalho. Inicia-se o artigo com a conceituação de negociação coletiva, bem como de suas principais modalidades e forma de aplicação. Após, o artigo trata da nova regra da prevalência do negociado sobre o legislado, introduzida pela Lei n. 13.467/2017 e, na sequência, sobre os danos à saúde e segurança do trabalhador causados pela aplicação desmesurada no novo instituto. Em sede de conclusões, afirma-se o caráter de exclusão social que cerca o referido dispositivo legal. A pesquisa vale-se de metodologia indutiva-dedutiva, por meio da análise doutrinária e jurisprudencial acerca do tema.pt_BR
dc.description.abstract[eng] The purpose of this article is to analyze the institute of minimum intervention in the autonomy of the collective will, introduced in art. 8º, § 3º of the CLT by Law 13,467/2017, as a factor of social exclusion, given that its application removes the legal protection of workers through collective bargaining, under the argument of modernization of labor relations. The article begins with the conceptualization of collective bargaining, as well as its main modalities and form of application. After that, the article deals with the new rule of the prevalence of the negotiated over the legislated, introduced by Law 13,467/2017 and, next, on the damages to the health and safety of the worker caused by the excessive application in the new institute, concluding for the character of exclusion the legal system. The research is based on an inductive methodology, through doctrinal and jurisprudential analysis on the subject.pt_BR
