Direitos humanos e direito internacional público: considerações à luz da tutela jurídico-internacional do ser humano que trabalha
[por] Articula-se a temática dos direitos humanos na perspectiva da classe trabalhadora, promovendo-se apontamento de diretrizes internacionais especificamente dirigidas à salvaguarda da dignidade do ser humano que trabalha. Investiga- se, como objeto de pesquisa, em que medida a proteção jurídico-internacional da classe trabalhadora contribuiu para o desenvolvimento do Direito Internacional Público. Demonstra-se que tal agrupamento humano, embora não pertencente às chamadas "minorias", sempre mereceu proteção jurídica especial a nível internacional em razão de suas múltiplas vulnerabilidades (sobretudo socioeconômica), fato ratificado, por exemplo, com a criação, já em 1919, da Organização Internacional do Trabalho (OIT). Aponta-se, nessa perspectiva, uma série de temáticas laborais por demais sensíveis à regência jurídica internacional. A pesquisa é qualitativa, eminentemente bibliográfica, tendo sido utilizado o método hipotético dedutivo. Confirma-se não apenas que a classe trabalhadora figura como histórico grupo vulnerável na seara dos direitos humanos, mas também que sua tutela jurídico-protetiva detém relevante papel para o próprio desenvolvimento do Direito Internacional Público. [eng] This research articulates the theme of human rights in the perspective of the working class and of specific international directives aimed at safeguarding the dignity of the human being who works. It’s demonstrated that this human grouping, although not belonging to the so-called "minorities", always deserved special international legal protection because of its multiple vulnerabilities (especially socioeconomic), a fact confirmed, for example, in 1919, with the foundation of the International Labor Organization (ILO). In this perspective, a series of labor issues that are very sensitive to the international legal regency, such as the fight against slave-like conditions, child labor and bullying, the protection of immigrant and refugee workers, protection of workers psychophysical health from the new morphologies of work in contemporary society and the recent trend, approved before the UN Human Rights Council, to emphasize the role of private companies in the protection and promotion of human rights. It ratifies not only that the working class figures as a historical vulnerable group in the area of human rights, but also that its legal protection protects the relevant role for the development of Public International Law. The research is qualitative, eminently bibliographical, using the hypothetical deductive method.
