Controle judicial das cláusulas integrantes dos instrumentos de negociação coletiva: restrições à atuação do Poder judiciário advindas com a reforma trabalhista - Lei n. 13.467/2017
[por] Investiga os limites das negociações coletivas em âmbito trabalhista e a atuação do Poder Judiciário quanto à apreciação das cláusulas integrantes dos instrumentos normativos coletivos, tendo em vista as alterações legislativas trazidas pela Lei Federal n. 13.467/2017 – Reforma Trabalhista – que acrescentou os arts. 611-A, 611-B e o § 3º do art. 8º à Consolidação das Leis do Trabalho, resgatando, para tanto, estudos sobre institutos específicos do direito coletivo do trabalho – negociação coletiva e os instrumentos normativos – debatendo-se quanto à compatibilidade da nova redação da Consolidação das Leis do Trabalho com a Constituição Federal de 1988, com fulcro nos princípios da inafastabilidade de jurisdição, autonomia privada coletiva, adequação setorial negociada e intervenção mínima da autonomia privada. [eng] The purpose of this article is to investigate the limits of collective bargaining in the labor field and the judiciary in relation to the assessment of clauses that are part of collective normative instruments, in view of legislative changes brought by Federal Law no. 13.467/2017 – Labor Reform – which added articles 611-A, 611-B and § 3º of art. 8º to the Consolidation of Labor Laws, rescuing, for this, studies on specific institutes of collective labor law – collective bargaining and normative instruments – debating on the compatibility of the new wording of the Consolidation of Labor Laws. Labor Laws with the Federal Constitution of 1988, with a focus on the principles of inafasability of jurisdiction, collective private autonomy, negotiated sectorial adequacy and minimal intervention of private autonomy.
