dc.description.abstract[por] O teletrabalho é uma inovação legislativa decorrente da interferência das transformações tecnológicas nas relações de trabalho, tendo por finalidade a melhoria das condições de vida laboral dos trabalhadores e, por corolário, da qualidade de vida destes. Examina-se o teletrabalho no Brasil a fim de verificar o alcance da mencionada finalidade. Para tanto, a partir do método dedutivo, será discutida a evolução legislativa pátria desde os primeiros tratamentos até a promulgação da Lei n. 13.467 (BRASIL, 2017), que regulamentou de forma específica o instituto, comparando-se com a legislação existente em outros países. Também será abordado o direito à desconexão do teletrabalhador, mormente o tratamento doutrinário e a legislação estrangeira, bem como a aplicação do Direito Comparado, com o intuito de colmatar as lacunas normativas e ontológicas existentes na CLT quanto ao cumprimento da finalidade principal do teletrabalho, dando-se ênfase às legislações portuguesa e francesa.pt_BR
dc.description.abstract[eng] Teleworking is a legislative innovation resulting from the interference of technological transformations in labor relations, which aim the improvement of living conditions of workers and, by consequence, their quality of life. The present study aims at examining teleworking in Brazil in order to ascertain the mentioned scope. To this end, from the deductive method will be treated the brazilian legislative evolution since the first few treatments until the enactment of Law n. 13.467 (BRASIL, 2017), which regulated the institute in a specific way, comparing it with the existing legislation in other countries. The right to disconnect the teleworker will also be addressed, particularly the treatment of legal doctrine and the foreign legislation, as well as the enforcement Comparative Law in order to fill in legal and ontological gaps existing in the CLT regarding the fulfillment of the main purpose of teleworking, emphasizing Portuguese and French legislation.pt_BR
