dc.description.abstract[por] Encontra justificativa no estudo da introdução do Instituto da Arbitragem como método de resolução de litígios individuais trabalhistas. Tal possibilidade se deu a partir da elaboração da Lei n. 13.467/2017 (Reforma Trabalhista), a qual inseriu o art. 507-A à CLT, dispondo em sua redação que poderá ser pactuada cláusula compromissória de arbitragem nas relações individuais de trabalho nos termos ali determinados. À guisa de conclusão, mesmo a legislação infraconstitucional estabelecendo a regulamentação da arbitragem nos dissídios individuais do trabalho, o texto constitucional veda qualquer ato de renúncia de direitos tutelados em prol do trabalhador, sendo-lhe indispensável a proteção estatal frente a iminência de regressão desses direitos.pt_BR
dc.description.abstract[eng] The present research finds justification in the study of the introduction of the Institute of Arbitration as a method of solving individual labor disputes. This possibility came about from the drafting of Law 13,467/2017 (Labor Reform), which inserted art. 507-A to the CLT, which states in its wording that an arbitration clause may be agreed upon in individual employment relationships under the terms determined therein. As a conclusion, showed that even infraconstitutional legislation establishing the regulation of arbitration in individual labor agreements, the constitutional text prohibits any act of waiver of rights protected in favor of the worker, being indispensable to him the state protection before the imminence of regression of these rights.pt_BR
