dc.description.abstract[por] A Lei n. 13.467, de 13/7/2017, que implementou a chamada "reforma trabalhista", introduziu no texto da Consolidação das Leis do Trabalho o "Título IV-A Da Representação dos empregados", que, em seus artigos 510-A e 510-D, regulamenta o art. 11 da Constituição Federal de 1988. O artigo aborda questões ligadas a essa modalidade de manifestação e participação dos trabalhadores no âmbito empresarial e sua influência sobre o movimento sindical. Primeiramente, busca-se traçar o aspecto histórico-normativo de sua criação, assim como a sua conceituação. Sucessivamente, trata-se das peculiaridades da modalidade disciplinada na lei em espeque. Por fim, tratando-se de forma de manifestação dos empregados de uma determinada empresa perante o seu empregador para a tutela de direitos individuais e coletivos, interessa saber quais suas imbricações quanto à ação coletiva, a fim de verificar se concorre para o fortalecimento dos laços de solidariedade que tipicamente englobam a categoria de uma determinada base territorial ou se concorre, por outro lado, para o seu enfraquecimento, em especial em tempos como os atuais em que se anuncia a crise do movimento sindical.pt_BR
dc.description.abstract[eng] The Bill n. 13.467 de 13/7/2017, known as the "labor reform", introduced in the text of the Consolidation of Labor Laws "Title IV-A Representation of Employees", which, in Articles 510-A and 510-D, regulates art. 11 of the Federal Constitution of 1988. The article addresses issues related to this modality of manifestation and participation of workers in the business sphere and its influence on the Trade union movement. First, it seeks to trace the historical-normative aspect of its creation, as well as its conceptualization. In turn, we approach the peculiarities of the disciplined modality in the referred bill. Finally, considering the employees’ manifestation from one certain company against the employer in the name of individual and coletive rights, it is important to know the implications of this manifestation in order to verify whether it contributes to the strengthening the typical solidarity bonds that are made in a territorial base or, in the other side, it contributes to the weakening of those bonds, especially in times like these, when there is a crisis in the trade union movement.pt_BR
