dc.description.abstract[por] Com o advento da reforma trabalhista de 2017, o legislador criou um capítulo na CLT para regular o dano material e, com maior ênfase, o dano moral decorrente da relação de emprego. O novo regramento suscitou dúvidas hermenêuticas e inúmeras ações diretas perante o Supremo Tribunal Federal. O presente artigo examina todos os pontos enfrentados, em especial a questão do cabimento do dano em ricochete, a tarifação do dano moral e a aplicação subsidiária de leis esparsas para colmatar o tema. O texto enfrenta outros pontos afins, enfatizando a interpretação conforme a Constituição.pt_BR
dc.description.abstract[eng] As of the 2017 Labor Reform, the legislator created a chapter in the CLT to regulate material damage and, in particular, moral damage resulting from the employment relationship. The new rule raised hermeneutical doubts and numerous direct actions were filed before the Federal Supreme Court. This article examines all the points faced, especially the issue of the appropriateness of the ricochet damage, the pricing of moral damage and the subsidiary application of sparse laws to resolve the issue. The text faces other similar points, emphasizing the interpretation in accordance with the Constitution.pt_BR
