Assim, ao tratar de direito do trabalho é crucial destacar a relevância dos entendimentos jurisprudenciais que oxigenizam o sistema jurídico brasileiro e, com isso, trata-se de compreender a importância da inovação de entendimentos jurídicos, especialmente nos tribunais superiores. Neste sentido, o artigo visa a problematizar uma importante alteração ocorrida no sistema jurídico-laboral recentemente, a partir do entendimento do Supremo Tribunal Federal na ADPF n. 323/DF, relacionada à ultratividade das normas coletivas da área trabalhista, que há muito tempo causou evidente celeuma jurídica na doutrina juslaboral. Em relação à problemática, o artigo visa a entender qual a relevância hermenêutica do debate jurídico em torno da ADPF n. 323/DF. Para tanto, adotar-se-á uma metodologia bibliográfica, por meio de um método dedutivo, com base na análise documental de referenciais bibliográficos e jurisprudenciais relacionados à teoria constitucional, especificamente à hermenêutica jurídica, bem como à realidade jurisprudencial da seara jurídico-laboral.[eng] Labor law is essentially related to social rights and social change. Therefore, when addressing Labor law, it is crucial to highlight the relevance of court precedents that constitute the Brazilian legal system, and then better, comprehend the importance of innovation in legal understandings, especially in higher courts. In this regard, this article aims to discuss an important recent change in the legal-labor system based on the understanding of the Brazilian Federal Supreme Court in ADPF No. 323/DF, related to the ultra-activity of collective labor norm, which has long been a source of legal controversy in labor law doctrine. Regarding the research question, this article aims to understand the hermeneutic relevance of the legal debate around ADPF No. 323/DF. The methodology applied is a bibliographical review, through a deductive method, based on the documentary analysis of bibliographical and court precedent references related to constitutional theory, specifically legal hermeneutics, as well as to the court reality of the legal-labor area.
