[por] Propõe a investigação do problema de pesquisa: qual o alcance da responsabilidade do empregador nos acidentes em home office? Com o crescimento da aderência ao home office durante a pandemia da covid-19 é possível imaginar que os acidentes de trabalho em casa aumentaram e por isto o artigo é justificado pela necessidade de investigar até onde um acidente ocorrido em casa caracteriza um acidente do trabalho e qual a responsabilidade do empregador. Com o objetivo de solucionar o problema da pesquisa, testa-se a hipótese em que o empregador é responsável desde a orientação do funcionário à emissão do CAT quando ocorrido o acidente do trabalho, mas não é responsável por todos os acidentes que ocorrem em horário de atividade laboral. Conclui-se pela comprovação da hipótese, entendendo que o empregador poderá ser responsável até mesmo por dolo ou culpa a depender do caso concreto. [eng] The present scientific article proposes the investigation of the following research problem: what is the extent of the employer’s liability in cases of accidents at home office? With the growing adherence to home office during the covid-19 pandemic it is possible to imagine that work-related accidents at home have increased and therefore the article is justified by the need to investigate how far an accident occurring at home characterizes a work-related accident and what is the employer’s responsibility. In order to solve the research problem, we test the hypothesis that the employer is responsible for the orientation of the employee to the issuance of the CAT when it is a case of occupational accident, but is not responsible for all accidents that occur during working hours. It is concluded that the hypothesis is proven, understanding that the employer can be responsible even for malice or guilt depending on the case.
