O gerenciamento algorítmico e a proteção constitucional em face da automação
[por] O art. 7º, XXVII da Constituição federal prevê, dentre vários outros direitos dos trabalhadores, a proteção em face da automação, na forma da lei. O constituinte, com isto, visava o desemprego estrutural e a precarização do trabalho. Ocorre que, vinte e cinco anos depois da promulgação da Constituição, o termo "Indústria 4.0" é cunhado para designar uma nova realidade que surge e, com ela, novos fatores de risco aos trabalhadores. O presente contexto passa a representar um risco decorrente não da automação da tarefa propriamente, a ser realizada pelo trabalhador, mas sim da tarefa que seria realizada por seus chefes e gerentes. O gerenciamento algorítmico, que consiste em práticas de supervisão, governança e controle conduzidas por algoritmos de software sobre trabalhadores remotos, representa agora um novo risco aos trabalhadores, decorrente de controle excessivo, ausência de transparência e de possibilidade de comunicação com o contratante, e até mesmo de práticas abusivas e discriminatórias. Assim, se faz necessário um alargamento na compreensão da proteção em face da automação, de modo a incluir o gerenciamento algorítmico dentre os fatores dos quais os trabalhadores possam ser protegidos. [eng] The article 7, item XXVII of the Federal Constitution provides, among several other workers rights, the protection against automation, according to the law. The constituent, with this, aimed at the structural unemployment and the precarization of labor. Twenty-five years after the promulgation of the Constitution, the term "Industry 4.0" is coined to designate a new reality that arises and, with it, new risk factors for workers. The present context starts to represent a risk arising not from the automation of the task to be performed by the worker, but from the task that would be performed by their bosses and managers. Algorithmic management, which consists of supervision, governance and control practices conducted by software algorithms over remote workers, now represents a new risk to workers, due to excessive control, lack of transparency and possibility of communication with the contractor, and even abusive and discriminatory practices. Thus, it is necessary to expand the understanding of protection against automation, in order to include algorithmic management among the factors from which workers may be protected.
