[por] Analisa a norma constitucional da unicidade sindical frente ao princípio da liberdade sindical, ambas garantidas pelo constituinte originário, bem como frente à Convenção n. 87 da OIT e ao pluralismo sindical. Eventual ratificação da Convenção 87 da OIT traz, para o ordenamento jurídico brasileiro, problemas de hermenêutica constitucional, que devem ser resolvidos mediante reflexão ampla e aberta pela sociedade, garantindo e promovendo a identidade constitucional e uma adequada oxigenação sindical. Em relação ao custeio sindical, demonstrar-se-á que a revogação da contribuição sindical, enquanto tributo, realizada pela Reforma Trabalhista foi formalmente adequada, bem como possui adequação substancial, eis que existem outras contribuições não compulsórias respaldadas pela Constituição da República Federativa do Brasil de 1988 e pela legislação infraconstitucional que promovem melhor a finalidade pública, garantindo mais igualdade material ao custeio sindical. [eng] This work has the power to analyze the constitutional norm of union unity against the principle of union freedom, both guaranteed by the original constituent, as well as the ILO Convention 87 and union pluralism. The eventual ratification of ILO Convention 87 brings, for the Brazilian legal system, constitutional hermeneutics problems, which must be resolved through broad and open reflection by society, guaranteeing and promoting constitutional identity and adequate union reinvention. In regards to Union funding, it will be outlined that the revocation of the union contribution made by the Labor Reform was formally adequate, and have substantial adequacy, as there are other non-compulsory contributions supported by the 1988 Constitution of the Federative Republic of Brazil and by the infra-constitutional legislation that better promotes the public purpose, guaranteeing more material equality to union funding.
